Terms of Service

These Terms of Service (“Terms”) apply to your use of the Whyzy Town website (the “Site”), operated by [OPERATOR NAME] (“Whyzy Town”, “we”, “us”) in Sydney, New South Wales, Australia. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. The Site includes simple learning activities for young children, which are meant to be used with a parent, carer or other grown-up who has accepted these Terms.

1. Using the Site

The Site provides free learning activities for young children and general information about the Whyzy Town YouTube channel. You may view, and print or share links to, pages of the Site for personal, non-commercial purposes. You agree not to:

  • use the Site in any way that breaks the law or infringes anyone’s rights;
  • try to interfere with, damage or gain unauthorised access to the Site or its hosting; or
  • copy, scrape or republish the Site’s content for commercial purposes without our written permission.

2. Intellectual property

The Whyzy Town characters (including Volta, Wattsy, Dot and Mango), artwork, songs, lyrics, videos, text and design of the Site and channel are owned by or licensed to [OPERATOR NAME] and are protected by copyright and other intellectual property laws. Except as allowed above or by law, you may not copy, adapt, distribute or use them without our written permission.

3. Our YouTube videos

Whyzy Town videos are hosted on YouTube. Videos shown on the Site load from YouTube only when you tap play. Watching or interacting with them is governed by the YouTube Terms of Service and the Google Privacy Policy. Our internal upload tool, Whyzy Town Uploader, uses YouTube API Services, and by using it we agree to be bound by the YouTube Terms of Service. How we handle information is explained in our Privacy Policy.

The grown-ups area of the Site links to websites run by others, such as YouTube, Google and government sites. We provide these links for convenience only. We do not control those sites and are not responsible for their content, availability or privacy practices.

5. No warranties

The Site and its content are provided “as is” for general information, learning and entertainment. We try to keep the content accurate and child-friendly, but we do not promise that it is complete, current or error-free, or that the Site will always be available. Our videos and the Site are not a substitute for professional educational, medical, or electrical safety advice. Always follow safe practices around tools and electricity, and supervise children.

6. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that, and to the maximum extent permitted by law, we are not liable for any loss or damage (including indirect or consequential loss) arising from your use of, or inability to use, the Site or any linked website.

7. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continuing to use the Site after a change means you accept the updated Terms.

8. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.
